رمانتیسیسم حقوقی: ساوینی و مفهوم volkgeist در حقوق

چکیده

ظهور ساوینی مقارن بود با اوج عقل‌گرایی طبیعی در ساحت تفکر حقوقی اروپا. مکتب طبیعی‌گرا واقعی بر نقش اجتماع در شکل‌گیری قوانین نمی‌گذاشت و برای تاریخ یک ملت در شکل‌گیری حقوق ارزشی قائل نبود. در چنین فضایی بود که ساوینی از روح جمعی برآمده از تاریخ یک ملت و نقش آن در ایجاد حقوق صحبت به میان آورد. ساوینی گفتمانی جدید در دنیای حقوق ایجاد کرد که وفق آن حقوق مانند زبان هر ملت یک پدیده منحصر به فرد اجتماعی-تاریخی و نه صرفاً عقلی و جهان‌شمول محسوب می‌شود. با این وجود عقاید ساوینی در نهایت ابهام و پیچیدگی مطرح‌ شده‌اند. در این میان، آنچه بیش از دیگر مفاهیم مطروحه از سوی ساوینی شگفتی حقوقدانان را موجب شده است، مفهوم volkgeist است که نویسندگان فارسی زبان با قدری مسامحه از آن با عنوان روح جمعی ملت یاد کرده‌اند؛ اما فی‌الواقع volkgeist ساوینی به چه معناست و خاستگاه تاریخی این مفهوم چیست؟ این نوشتار می‌کوشد در چارچوبی توصیفی-تحلیلی از معنی volkgeist در نظر ساوینی پرده بردارد. با ایضاح این مطلب، در پایان مشخص خواهد شد که ساوینی بیش از آنکه حقوقدانی تاریخ گرا باشد، آغازگر نوعی رمانتیسیسم حقوقی است.

Savigny's legal philosophy came to prominence when naturalistic rationalism signified the predominant mode of legal thinking in Europe. In the universe of legal naturalism, society as a whole did not undertake an important role in the formation of laws. Nor was history accorded with significance by those following the natural law school. It was in this environment that Savigny spoke of the 'common consciousness of people' and its prevailing presence in conceiving law. However, Savigny's views are expressed in the most ambiguous of manners. This essay commits itself to clarify the legal foundation of Savigny's jurisprudence through a philosophical and historical lens.
