The efforts to provide energy from fossil fuels and their negative environmental consequences, such as the intensification of greenhouse gases and the problem of global warming, has encouraged the countries of the world to extract power from renewable energy sources. In the meantime, the role of intellectual property rights in the transition from fossil fuels to renewable energies is considered as an important step in the direction of climate change reduction policies. The technology resulting from the processing of energy from natural resources is essentially considered intellectual property, and its monopoly is mainly held by industrialized countries that do not want to spread it. The technology emerging from the processing of natural resources is essentially regarded as an intellectual asset, and its monopoly is mainly held by industrialized countries that do not want to diffuse it. With this premise, the question is, what prospects can be promised for renewable energies in the face of intellectual property rights? The findings of the research indicate that intellectual property rights are a serious obstacle to the transfer of clean technologies. In this regard, compulsory licensing mechanisms and the doctrine of exhaustion, along with international cooperation, can greatly limit the monopoly resulting from intellectual property rights. The result of the research proves that if global energy security is targeted through renewable energy sources, intellectual property rights should be given a moderate and secondary role and these technologies should be considered as “public property”.
