ارزیابی تعهدات دولت‌ها در قبال حق بر سلامت، تأمین اجتماعی و استفاده از اماکن عمومی افراد کوتاه‌قامت

چکیده

مقدمه: کوتاه‌قامتی اختلالی ژنتیکی است که عوامل ایجاد آن در زیرگروه بیماری‌های نادر طبقه‌بندی می‌شوند و تعریف تخصصی سازمان بهداشت جهانی از معلولیت، بر آن دلالت دارد. با وجود این، کوتاه‌قامتان تاکنون در ایران به‌عنوان توانخواه به رسمیت شناخته نشده‌اند. این امر در کنار عدم توجه کافی به مشکلات و نیازهای خاص آنان در حیطه‌های حق بر سلامت، تأمین اجتماعی و دسترسی به اماکن عمومی، موجب به حاشیه رانده شدن آن‌ها و محرومیت از برخی حقوقشان شده است. همچنین این افراد به‌عنوان بخشی از گروه‌های آسیب‌پذیر جامعه، با چالش‌های مضاعفی روبرو هستند که کمتر مورد توجه قرار گرفته‌اند. وانگهی وضعیت حقوق بشری افراد کوتاه‌قامت در کشور ایران آنچنان که شایسته است تاکنون مورد تحقیق قرار نگرفته و به ندرت، از منظر پزشکی یا اجتماعی بررسی شده است. در سطح بین‌المللی نیز می‌توان گفت که وضعیتی تقریباً مشابه، اما نسبتاً بهتر وجود دارد. بنابراین باید چاره‌ای اندیشید تا بتوان در چارچوب قانون، تعهداتی را در راستای احقاق حقوق این افراد برای دولت و دیگر نهاد‌ها ایجاد کرد.
روش‌ها: در این مقاله دو پرسش اصلی مطرح شده است:
الف. با توجه به اسناد و سازوکارهای حمایتی حقوق بشر و قوانین داخلی کشورها چگونه می‌توان به احقاقِ حقوق افراد کوتاه‌قامت پرداخت و آیا تعهدات موجود در این حیطه کافی است؟
ب. چه چالش‌هایی پیش روی افراد کوتاه‌قامت وجود دارد که مانع از برخورداری آن‌هااز حقوقشان می‌شود؟ بدین منظور با پیروی از روش تحقیق تحلیلی-توصیفی به همراه جمع‌آوری اطلاعات با مراجعه مستقیم به منابع کتابخانه‌ای فیزیکی و در بستر فضای مجازی، به بررسی پاسخ این پرسش‌ها پرداخته‌ایم. سپس در حوزه‌های سیاست‌گذاری، حقوقی و اجتماعی راهکارهایی ارائه کرده‌ایم که به لحاظ فنی می‌توان آن‌هارا از جنس تعهدات بر دوش دولت‌ و دیگر نهادها در نظر گرفت.
یافته‌ها: بخش قابل‌توجهی از جمعیت کوتاه‌قامتان ایران از نظر بیمه‌های درمانی، تأمین اجتماعی و یافتن شغل مناسب با چالش‌های بسیاری مواجهند. حتی برخی از آنان به‌رغم داشتن تحصیلات دانشگاهی یا مهارت‌هایی در زمینه‌های ‌ورزشی، هنری و غیره تنها به خاطر شرایط فیزیکی از ادامة علایق و یافتن شغل مناسب محروم شده‌اند. چالش قابل‌توجه دیگری که این افراد در زندگی روزمره خود به صورت مستمر با آن مواجهند، نامتناسب بودن اماکن و وسایل نقلیه عمومی با فیزیک جسمانی آنان است؛ به‌نحوی‌که در بسیاری موارد، امکان بهره‌مندی لازم را از تسهیلات مذکور ندارند که این مورد می‌تواند به‌عنوان عاملی جهت به حاشیه رانده شدن این افراد به حساب آید. البته علی‌رغم انجام برخی اقدامات مؤثر در راستای متناسب‌سازی اماکن عمومی و فضاهای شهری مانند دستگاه‌های خودپرداز، نیاز بیشتر به متناسب‌سازی این اماکن و فضاها کماکان احساس می‌شود. تأمین و تخصیص وسایل نقلیه عمومی نیز به‌گونه‌ای که کوتاه‌قامتان قادر به استفاده مستقل از آن‌ها باشند از دیگر ضروریات است. علاوه بر این، تبعیض و نادیده انگاشتن قابل‌توجهی نسبت به کوتاه‌قامتان وجود دارد که گاهاً با تمسخر و تحقیر یا انگ مؤدبانه همراه است؛ آنچه که مانع مشارکت آنان در فعالیت‌های اجتماعی می‌شود. همچنین در مقوله ازدواج و حمایت از بنیان خانواده، کوتاه‌قامتان به کمک بسیاری از سوی دولت و دیگر نهادها نیاز دارند که این کمک، شامل حمایت‌های تخصصی پزشکی از آنان نیز می‌شود. در این راستا ورود جامعه آکادمیک در حوزه‌های گوناگونِ مرتبط با چالش‌های حقوق بشری کوتاه‌قامتان نیز می‌تواند سهم مؤثری در بهره‌مندی آنان از حقوقشان داشته باشد.
نتیجه‌گیری: اگرچه که در هیچ‌کدام از اسناد حقوق بشری بین‌المللی و منطقه‌ای صراحتاً به افراد کوتاه‌قامت اشاره‌ای نشده است اما با رویکرد حقوق بشری به کوتاه‌قامتی، می‌توان به دو روش آن‌هارا تحت پوشش سازوکارهای حمایتی حقوق بشر قرار داد: احتساب در زمره افراد توانخواه یا طبقه‌بندی به‌عنوان زیرمجموعه‌ای از گروه‌های آسیب‌پذیر. این احتساب، اهمیتی دوگانه دارد؛ فرآیند ادغام اجتماعیِ آنان را بهبود می‌بخشد و «حق بر شناخته شدن» را برای آنان در ردیف افرادی که نیازمند توجه خاص از سوی دولت‌ و دیگر نهادها هستند به رسمیت می‌شناسد و از این حیث، اشاره‌ای برجسته‌تر به تعهدات دولت‌ در قبال این افراد می‌کند؛ البته مشروط به آنکه عزم و اراده کافی به همراه مکانیسم‌های نظارتی جهت اجرای این تعهدات وجود داشته باشد.

Introduction
Being of short stature is a genetic disorder, the causes of which are classified in the subgroup of rare diseases, and the World Health Organization's specific definition of disability implies it. Nonetheless, short-stature persons have not been formally recognized as disabled in Iran up until today. This lack of identification, along with a failure to pay appropriate attention to their problems and special needs regarding the right to health, the right to social security, and the right to use public places, has led them to be marginalized and deprived of some of their rights. Additionally, as part of a vulnerable group in society, these individuals face extra challenges that are rarely addressed. Furthermore, the human rights conditions of short-stature persons in Iran have not been researched as thoroughly as they deserve, and they have seldom been investigated from a medical or social perspective. The international situation is almost the same, although relatively better. Therefore, a solution is needed within the framework of law, defining obligations for governments and other actors to fulfill their rights.
Methods
Two key questions are addressed in this article:

A) Considering the protective mechanisms of human rights, related documents, and domestic laws of various countries, how can the rights of short-stature persons be fulfilled, and are current obligations sufficient for this purpose?
B) What challenges do short-stature persons face that prevent them from fully enjoying their human rights?

Following an analytical-descriptive research approach and gathering data through direct reference to library resources—both physically and online—we have examined appropriate responses to these questions. Subsequently, we have proposed policy-making, legal, and social strategies that are technically understood as the obligations of the state and other actors.
Results
A significant number of short-stature persons in Iran struggle with challenges related to medical insurance, social security services, and finding appropriate employment. Even some of them, despite having an academic education or skills in sports, arts, and other fields, are deprived of pursuing their interests and securing suitable jobs due to their physical conditions. Another considerable challenge they continuously face is the inadaptability of public facilities, spaces, and transportation systems to their physical condition. In most cases, they cannot use these facilities, which further marginalizes them. Although some effective measures have been implemented to adapt public places and urban areas (such as ATMs), the need for greater compatibility remains. Providing accessible public transportation for short-stature persons is another necessity.
Additionally, short-stature persons experience considerable discrimination and neglect, sometimes accompanied by ridicule, humiliation, or stigmatizing attitudes, which exclude them from social participation. Moreover, regarding marriage and family foundation support, they require substantial assistance from the government and other institutions, including specific medical support. Engaging the academic community in addressing various aspects of the human rights challenges faced by short-stature persons could significantly contribute to fulfilling their rights.
Conclusions
Although none of the international or regional human rights documents explicitly mention short-stature persons, it seems possible to protect them under human rights mechanisms b y adopting a human rights-based approach in two ways: recognizing them as disabled or categorizing them as a vulnerable group. This proposal holds dual importance—it can improve their social integration and realize their "right to be recognized" as individuals requiring special attention from the state, social organizations, and the private sector. In this sense, it highlights the state’s obligations toward these persons more prominently, provided there is sufficient determination and monitoring systems to implement these obligations.
