Informed consent is a process whereby a patient, after receiving sufficient information, decides whether to accept or refuse treatment. Using a descriptive-analytical method and a comparative approach, this study examines the legal foundations and components of informed consent under the laws of Iran, Germany, Italy, and Spain. The findings indicate that, contrary to a common perception, informed consent is not without a legal basis in Iranian law; rather, the rules governing it are expressly or implicitly provided for in various regulations. Nevertheless, the fragmentation of these regulations and the absence of a coherent framework have resulted in ambiguity. By contrast, in Germany, Italy, and Spain, informed consent and its implementation are clearly and coherently regulated under a single law. Based on the comparative analysis, reform of the Iranian legal system should include enacting a comprehensive law on informed consent or systematically incorporating comprehensive provisions into the Civil Code; adopting the patient’s actual decision-making capacity rather than legal age as the relevant criterion; clarifying the concept and categories of “legal guardian”; taking into account the views of patients lacking legal capacity to the extent of their abilities; precisely defining disclosure requirements, with particular emphasis on the comprehensibility of information and its impact on patient decision-making; and clarifying the responsibilities of those involved in the consent process.
