In the age of globalization, foreign investment has assumed a decisive role as a vital pillar of economic growth. Countries capable of attracting international financial resources proceed along the path of development with greater acceleration. In this context, Public-Private Partnership (PPP) emerges as an innovative mechanism, providing a suitable platform for financing infrastructure projects. This mechanism not only reduces the financial burden on the government but also facilitates the transfer of technology and the utilization of private sector management expertise.
Nevertheless, the success of this model is contingent upon the existence of a transparent and efficient legal framework.
The present study aims at the legal feasibility assessment and the identification of challenges concerning foreign investment through Public-Private Partnerships within Iran's legal system. The main objective is to elucidate the governing laws, identify permissible areas for investment, and analyze the inhibitory legal obstacles that, despite supportive policies, practically impede the realization of these partnerships. This research seeks to answer the question of whether the current Iranian laws provide the necessary security and stability for long-term partnership contracts.
