Legitimizing the acquisition and entitlements redistribution through voluntary exchange, is one of the fundamental challenges of the philosophy of contract law. In contract law, voluntary exchange of property and financial rights justifies the acquisition and entitlements distribution. This distribution through voluntary exchange derives its legitimacy from certain values, including procedural justice. Voluntary exchange, on the one hand, justified the distribution and redistribution of contractual entitlements and on the other hand, the premise of contract theory is procedural justice. The question is why does voluntary justifies the distribution and redistribution of entitlements contractual and how does the contract theory presuppose procedural justice? In this regard, three theories have been proposed in contractual procedural justice: pure, perfect, and imperfect. Pure theory, due to the inability to justify corrective interventions, and the perfect theory, which reduces justice to external welfare measures, are both flawed and only an imperfect theory can explain the theoretical and practical harmony of contract law. According to this view, institutions such as the option of lesion are not exceptions to the principle of free will, but rather part of the same procedural of voluntary exchange and the redistribution of entitlements contractual is in line with to be voluntary of transaction, not its violation. The justification for voluntary exchange is not absolute and its effectiveness in ensuring contractual justice is mostly found in the imperfect theory.
