Public economic law, as the state's instrument for structuring and managing the economy, remains centralized in Iran despite extensive efforts. Given that a centralized public economic system is inefficient, the need to decentralize this system has been recognized in both legislation and the executive structure. A prerequisite for such decentralization is the identification of the institutional barriers to the decentralization of Iran’s public economic law, which constitutes the objective of this study. Accordingly, the research question is: “What institutional barriers hinder the decentralization of Iran’s public economic law?”
The present study adopts a descriptive–analytical approach, and the data were collected through a library-based method by reviewing prior research and existing laws. The findings indicate that, despite efforts undertaken through the Constitution and ordinary legislation to establish local institutions, free zones, and provincial planning councils, the country’s public economic law has remained centralized.
Centralization is identified as one of most fundamental challenges of public economic law and reveals three principal institutional barriers. First, at the legislative level, the predominance of national laws and regulations deprives local institutions of decision-making authority, while higher-order norms, such as the General Policies of the System, contain no explicit provisions in favor of decentralization. Second, the financial dependence of decentralized institutions on central government budgets limits their autonomy and effectively reduces them to executors of centralized rules. Third, the dominance of oversight by centralized bodies, such as the Administrative Justice Court, over public-economic regulation by local institutions has weakened opportunities for participation by decentralized private-sector actors.
