Internet of things has a substantial role to increase productivity and decrease costs. However, decentralized and distributed nature of produced and collected personal data in this technological context has created some ambiguities in the field of commodification and domain of proprietary rights and caused Iranian legal system to encounter fundamental challenges. The fundamental question is whether personal data can be modified and be possessed according to traditional law of property. findings show that European Union in order to prevent exclusive control on personal data and elimination of unjustified limitations to access and enjoyment of them, has adopted the policy based on “right of access to data” instead of “right of ownership” approach. The Iranian legal system faces lack of comprehensive laws in protection of personal data, ambiguity in commidifying and ownership of data and absence of clear framework for governing legal system on them in the internet of thinga context. Accordingly, given the unique nature of personal data, the right of personal data cannot be clarified in context of traditional property law, but it must be recognized a “special property right” as a legal solution for its protection whereby the data subject is the primary entitled party to the personal data and is granted a bundle of rights including the right to be informed, restriction of processing, access, use, rectification and deletion of personal data under specified conditions and transfer of personal data shall only done with their explicit consent
