Abstract
In traditional civil liability systems, causation is recognized as the central criterion for attributing liability. This means that the obligation to compensate for damages is justified only when a causal link between the harmful act and the damage is established. However, this approach faces serious challenges in the context of modern technologies, environmental risks, and complex hazards, where absolute scientific certainty about the seriousness of damages is unavailable. In such domains, the traditional civil liability system proves less effective, as insisting on fully proving causation in cases characterized by high risks but ambiguous and multi-causal conditions may result in the denial of compensation. This article aims to weaken the concept of classical causation and demonstrate how civil liability can shift from the traditional causation-centric model toward a model grounded in uncertainty and risk. Employing a descriptive-analytical approach, this research has concluded that the traditional causation model falls short when addressing the structural uncertainties and risks of contemporary societies. Within this framework, civil liability should no longer solely rely on "causal certainty" but instead focus on the institutional management of uncertainty. By weakening the classical causation concept, uncertainty can emerge as a novel foundation for civil liability.
