کاهش تولید پسماند در حقوق محیط زیست ایران

چکیده

یکی از راهبردهای اصلی در مدیریت پسماند، کاهش تولید این مواد زیانبار در جریان تولید و مصرف کالاها است که برای این منظور اتخاذ سازکارهای مختلف از جمله تدابیر حقوقی برای به حداقل رساندن تولید این مواد در سه مرحله تولید، عرضه و مصرف کالا لازم می نماید. این مقاله به روش توصیفی، تحلیلی و آسیب شناسی حقوقی و با هدف شاخت خلاءهای قانونی در کاهش تولید پسماند به بررسی این مسأله می پردازد که آیا در حقوق محیط زیست و حقوق کالا در ایران با توجه به جدی بودن معضل تولید و انباشت پسماندها، سازکارهای مقتضی برای پیشگیری از تولید پسماند و در نتیجه حفاظت محیط زیست و صیانت از منابع طبیعی اتخاذ شده است یا نه و اینکه چالشهای موجود کدام است؟ این مقاله با ارائه یک مبنای نظری و ارائه الگویی برای مقررات گذاری برای کاهش تولید پسماند در سه مرحله، سرانجام نتیجه می گیرد که سازکارهای مقتضی برای به حداقل رساندن تولید پسماند در قانون مدیریت پسماندها و قوانین مرتبط دیگر ارائه نشده و لازم است تا با اصلاح این قوانین تدابیر مناسب برای الزام، تسهیل و تشویق کاهش تولید پسماند اتخاذ شود.

چکیده [English]

Waste minimization is the first process of waste management hierarchy which requires various legal mechanisms to minimize the amounts of produced wastes. The main question of this article is whether are there appropriate legal mechanisms for waste prevention in Iran’s environmental law or not and what are the legal challenges in this field? This article based on a descriptive and analytical method, exercises the legal challenges and lacunas in minimization of waste in three stages of waste generation: production, supply and consumption of the products. The study explores the deficits of the Waste Management Act of Iran and other production laws in this regard. Finally, it concludes that the lack of appropriate obligatory, voluntary and accelerative instruments for prevention of waste production, will undermine the waste management system in Iran and so taking necessary legal devices for waste prevention is demanded.
