اصلاح قانون اساسی (فلسفه، قواعد و محدودیت‌ها)

چکیده

اصلاح قانون اساسی یکی از مهم‌ترین مباحث مطرح در نظریه‌های حقوق اساسی است. قانون اساسی به عنوان سند بنیادین یک کشور نمی‌تواند عمری همیشگی داشته باشد، زیرا همچون هر محصول انسانی ممکن است اشتباهاتی در آن رخ دهد. علاوه بر این افکار و دیدگاه‌های مردم و بازیگران سیاسی و حتی نویسندگان متن در طول زمان تغییر می‌کند و قانون اساسی نیاز به تغییر پیدا می‌کند. ممکن است متن قانون اساسی از طرق رسمی که در خود قانون اساسی پیش بینی شده‌اند یا طرق غیررسمی تغییر کند. این مقاله به دنبال بررسی شیوه اصلاح رسمی قانون اساسی است که مبنای آن چیست، مفاهیم مشابه با اصلاح چه هستند، چه قواعد و فرایندی بر اصلاح حاکم است و محدودیت‌های حاکم بر اصلاح چیستند. ازآنجاکه قدرت مؤسس باعث پیدایش قانون اساسی می‌شود در این مقاله به نسبت قدرت اصلاح با قدرت موسس نیز پرداخته شده است.

چکیده [English]

Constitutional reform is one of the most important issues in constitutional theories. The constitution as a fundamental document of a country can not last forever, because like any human product, mistakes can occur in it. In addition, the thoughts and opinions of the people and political actors and even the authors of the text change over time and the constitution needs to be changed. The text of the constitution may change from the formal methods provided for in the constitution itself or the informal methods. This article seeks to examine the method of formal constitutional amendment, what is its basis? What are similar concepts? What rules and process govern the constitutional amendment? And what are the limitations of constitutional amendment? Since the constituent power gives rise to the constitution, this article also deals with the relationship between the constituent power and the amendment power.
