حل و فصل دعاوی سرمایه گذاری ناشی از پاندمی ها به ویژه کووید-19 با تکیه بر حفظ منافع دولت میزبان

چکیده

با توجه به اینکه در وضعیت شیوع بیماری‌های فراگیر جهانی به خصوص در مورد کووید-19، تمام ظرفیت کشورها به مقابله با گسترش بیماری و حفظ سلامت عمومی جامعه اختصاص داده می‌شود، بدیهی است که دولت‌های میزبان در شرایط بحرانی نمی‌توانند مانند شرایط عادی به تمام تعهداتی که در خصوص حمایت از سرمایه‌گذار خارجی در معاهدات سرمایه‌گذاری پذیرفته‌اند پایبند باشد و حتی بعضی از اقدامات پیشگیرانه آن‌ها موجب ورود خسارت به سرمایه‌گذار می‌شود. رجوع سرمایه‌گذار به داوری در زمان شیوع بیماری و یا احتمال طرح دعوا توسط سرمایه‌گذار پس از کنترل بیماری، می-تواند دولت‌ها را در اقداماتی که باید برای حفظ جان شهروندان خود انجام دهند، محدود نماید. این مقاله با هدف تمرکز دولت‌های میزبان بر حفظ جان شهروندان و سلامت عمومی جامعه، با روش توصیفی-تحلیلی به این سؤال پاسخ می‌دهد که دولت میزبان در دعاوی سرمایه‌گذاری ناشی از بیماری‌های فراگیر جهانی از جمله کووید-19 بر اساس معاهدات سرمایه گذاری چه دفاعیات شکلی و ماهوی جهت حفظ منافع اساسی خود در اختیار خواهد داشت.

چکیده [English]

Given that in the event of outbreak of pandemics, especially in the case of Covid-19, all capacities of the countries are allocated to prevent the spread of the disease and maintain public health, it is obvious that host states in crisis situations cannot abide by all obligations they have assumed under Investment treaties for protection of foreign investor, as they do in normal situations, and even some of their preventive measures will cause damage to the investor. The investor's recourse to arbitration in the event of an outbreak of a pandemic or the possibility of filing action by an investor after controlling the disease can limit the measures a state can do to protect the lives of its citizens. With the aim of focusing of the host states on protecting the lives of citizens and the public health of society, this article, using a descriptive-analytical method, answers the question of what procedural and substantive defenses under investment treaties, the host state may assert against the investor's claims resulting from state measures in pandemic situations to protect its essential interests.
