China is not only the first importer of crude oil, but it is also regarded as the biggest emitter of greenhouse gases in the world at the present time. Therefore, this country has enacted a wide range of environmental laws and regulation in order to reduce GHG emissions and fulfill its international commitments as well. These laws and regulation have direct effects on refineries and petrochemicals, as the main consumers of crude oil. At first, this article describes laws and regulations affecting the activity of downstream sector of oil industry in China. Then, in second chapter, Chinese independent refineries as secondary actors of downstream sector are introduced and their position in new environmental and legal system of China is analyzed. Finally, it is concluded that it seems suboptimal for the Islamic Republic of Iran to merely focus on selling crude oil to independent refineries. Because, these refineries are subject to numerous legal impediments and if the new Chinese legal and environmental system is taken into consideration, the existence of the mentioned refineries in future is uncertain and doubtful.
