			<abstract>  Contract is deemed to be law of the contracting parties. If the &quot;law&quot; be Kantian law, this means that the principle of the autonomy of the will is the basis of the validity of contractual content. Thus, other contractual principles, including the principle of good faith, equity and contractual justice (in the French Law) and the principles of negation of hardship and no harm (in the Iranian law), must be in harmony with the principle of autonomy of the will. However, is this possible to avoid the social meaning of law which is a reflection of a naturalist view of the law of contracts and search for a new foundation for the validity of the content of a contract? If so, the place of the principle of autonomy would be reduced from a contractual foundation to a source for contractual implementation leading to the improvement of the aforementioned principles and adjustment of the contract? This research, through a comparative analysis in the Iranian and French laws, is to deal with the said question.  </abstract>

			<abstract>Abstract The primary right of blood heirs in the murder is retaliation .but if there was permanent or temporary obstacles in implementation of this right there is disagreement between scholars about nature of their second right .some believe that religious reason require we can not determine compensation .but some believe that once there was obstacle in implementation of retaliation  blood heirs can demand compensation .some scholars have an intermediate view that require neither full drop nor full confirmation of compensation .they say that criterion is fault murderer or lack of it in process of implementation of the punishment. Intellectual and religious foundation of this approaches show that the first approach is invalid.and we should accept consolidation of second and third approach.    </abstract>

			<abstract>In this article, the authors try to analysis the theory of good governance and its indices in Nahjolbalagheh with the contextual or communitarian approach. By attention two reason, this approach was opted among the other approaches in hermeneutic paradigm: 1. As opposed to them, this approach doesn’t believe to discursive plurality and variable epistemology 2. Presumptions in this approach is more suitable with the subject of this research because of attention to the reading of text on the basis of context in a certain community or society with the fixed foundations from ontological and epistemological aspects and fundamental importance of  its certain  meanings, values and culture. So, the subject of good governance and its indices in the Nahjolbalagheh, has been depicted in the framework of supra time- local ideal type in the context of Islamic and monotheist society with the contingent and contextualized acceptance all today indices of this concept in  the west political thought.  </abstract>

			<abstract>Out of all Imami jurisprudential sources, due to its immunity and centrality, the Quran is given priority to other religious sources. It not only considers different aspects including belief, prayers, morality and politics, but also pays particular attention to juridicial debates such as tort liability, and remedy(compensation), all definite issues which lead to tort liability, including destruction, indirect causation, extortion payment of undue, and management of the anather,s property are referred to in some verses, some verses refer to each consept individually and some others, with respect to the generality of the verse, include all-the-mentioned issues. Islamic legal experts have inferred many of the rules from the Quranic verses.    </abstract>

			<abstract>Following the occupation of Iraq by foreign troops in 2003, the Abu Ghraib jail near Baghdad, became a place for holding opponents and protesters to occupation. During keeping the prisoners in this prison, many abuses by the American military that was in charge of Bureau of Prisons occurred against the prisoners. Because the trial and punish those accused of international crimes depends on specification criminal committed acts according to the rules of international criminal law, in this study, we review mistreated authorities of Abu Ghraib prison from the perspective of international law Criminal. With study were done committed crimes in this Prison, including “sexual violence” and “torture” we conclude that U.S.accused of Abu Ghraib prison committed crimes against humanity and war crimes.    </abstract>

			<abstract>One of institutions that there is doubt about its nature is Islamic Azad University. In Article 5 of the new constitution of Islamic Azad University determined at first as a non-governmental public institution, and in later amended, a non-private non-governmental institution. The term &quot;non-private non-governmental organization&quot; is not recognized within the institution in law and it appears  that Council&#039;s goal from using  non-governmental near non-private is public. But is the Islamic Azad University a non-governmental public institution? There are some of public law personality&#039;s features such as doing public service and using some of the power rating in the university but in the other criteria, it has the privacy law persons features. Despite in the new Constitution, university is called as a non-governmental  public institution but according to civil service management act, identification or creation and abolishing a non- governmental public institutions do only by monopoly of the Islamic Consultative Assembly. Therefore if we want to know the university as a non-governmental public institution we need to clarify the identification as a non-governmental public institution by the legislator.  </abstract>
