بررسی تعهد دولت ها نسبت به امنیت آب در حقوق بین‌الملل

چکیده

رابطه آب و انسان همواره ماهیتی دوگانه داشته است. از یک‌سو انسان و حیات اوست که به وسیله آب حفظ می­شود و از سوی دیگر حفظ کمیت و کیفیت آب‌های شیرین موجود در این کره خاکی در گروی چگونگی فعالیت­های انسان است. هم‌زمان با شدت گرفتن بحران آب در جهان، تلاش برای رفع آن و ایجاد حالت امنیت آب به یکی از دغدغه­های مهم جامعه بین­المللی بدل شده است. مسئله مهمی که در این زمینه جلب توجه می‌کند این است که آیا حقوق بین‌الملل تاکنون توانسته است دولت‌ها را به تأمین امنیت آب متعهد سازد؟ در پژوهش حاضر سعی شده است با استفاده از داده­های کتابخانه­ای و روش توصیفی- تبیینی این مسئله مورد واکاوی قرار گیرد. بررسی‌ها نشان می­دهد که مسئله امنیت آب اگرچه تاکنون به طور مستقیم موضوع قواعد حقوق بین‌الملل واقع نشده، لیکن بر اساس اصول و قواعد کلی و مقررات سایر حوزه‌های حقوق بین‌الملل و در راستای تأمین صلح و امنیت بین­المللی، می‌توان تعهداتی را استنباط کرده و الزاماتی را متوجه دولت‌ها دانست و به این ترتیب خلأ حقوقی درباره تأمین امنیت آب را ترمیم کرد؛ هرچند اتخاذ گام مؤثر در این مسیر نیازمند آن است که بنیان روابط دولت­ها، این کنشگران اصلی عرصه بین­الملل از سطح همکاری فراتر رفته و بیش از پیش به همبستگی و بهره­گیری از مشارکت دیگر کنشگران ذی‌ربط بیانجامد. البته هم‌زمان تلاش در جهت توسعه حقوق بین‌الملل نیز در این زمینه ضروری می‌نماید.

چکیده [English]

The relationship between water and human beings has always had a dual nature. On the one hand, it is human and his life that is preserved by water and on the other hand, conservation of quantity and quality of existing fresh waters on the Earth depends on human activities. With intensifying water crisis in the world, attempts to eliminate it and establish a state of water security have become one of the major concerns of the international community. The main issue is that whether international law has been able to oblige States to provide water security? In this study, this issue is examined by using library data and descriptive- analytical method. Studies show that although international law has not addressed the issue of water security directly; but on the basis of general principles of international law, we can infer obligations and impose requirements on States and thus, remedy the vacuum on water security. This study maps out such principles in order to sketch a framework for the governing rules of water security in international law.
