چکیده
بازار کالاهای فرهنگی از دیرباز با دو مشکل اساسی مواجه بوده است: عدم دسترسی مشتری به صاحبان حق برای کسب اجازه انتفاع و نقض حقوق پدیدآورنده. این موانع در کنار ملاحظات اقتصادی، منجر به ظهور سازمان‌های مدیریت جمعی به عنوان پل ارتباطی بین پدیدآورنده و مصرف‌کننده شدند. به طوری که امروزه با توجه به گسترش اشکال و تعداد بهره‌برداری و تنوع و تعدد آثار ادبی ـ هنری، به جرئت می‌توان گفت که اجرای کامل حقوق صاحبان این آثار، بدون وجود سازمان‌های مدیریت جمعی، غیرممکن است. توجه به این واقعیت و همچنین الزامات سیاست بین‌المللی در اجرای حداقلی از استانداردهای مالکیت ادبی و هنری برای امکان عضویت در مجامع مهم بین‌المللی و نقش‌آفرینی سیاسی و اقتصادی در آن‌ها، باعث شده است که در سال‌های اخیر توجه ویژه‌ای به این سازمان‌ها در کشورمان شکل بگیرد. مسلماً ایجاد و تمشیت درست این سازمان‌ها، درگرو شناخت کافی از آن‌ها و درک تعامل این بنگاه‌ها با نهادهای مختلف حقوقی است.

Abstract
The market for cultural and artistic goods has long faced two fundamental problems: unavailability of the copy right holders to the clients, and the illegal usage of intelligent properties of others. These difficulties along with economical considerations have led to the formation of the Collective Management Organizations (CMOs), who closed the communication gap between the producers and the users of their products. Considering the present expansion rate of the usage of all forms of arts, it may be impossible to protect the copy rights without the intervention and management of the CMOs.
The international policies to require the enforcement of a basic standard to protect the rights of the intellectual property owners within the international community in the recent years has brought special attention to the CMOs in our country. Obviously, formation and development of these organizations largely depends on their interaction with various legal entities and making their presence known to these entities.
