ابعاد حقوقی میراث مشترک بشریت در فضای ماورای جو

چکیده

     مقاله حاضر که به فضای ماورای جو با رویکردی حقوق بشری نگریسته، پس از بیان مفهوم، پیشینه و عقاید مخالفان اصل میراث مشترک بشریت در فضای ماورای جو، به تحلیل عناصر پنج­گانه­ی آن شامل: غیرقابل تخصیص بودن، تقسیم منصفانه منافع، نفع بشریت، مدیریت بین­المللی و استفاده صلح­آمیز پرداخته است که مهمترین دستاورداین مقاله، پاسخ به برخی از چالش­های موجود در زمینه­ی­ شناسایی فضای ماورای جو به عنوان میراث مشترک بشریت می­باشد و می­تواند دستیابی هرچه بیشتر کشورهای فاقد فناوری فضایی به فضای ماورای جو را توجیه نماید. امروزه، نظریه­ای که فضای ماورای جو، کره ماه و سایر اجرام آسمانی را میراث مشترک بشریت می­داند، آنها را غیر قابل تصاحب و تملک دانسته و معتقد است منافع حاصل از آنها باید به نحو عادلانه میان کشورها تقسیم شود به­طوری که در کنار منافع کشورهای در حال توسعه، تلاش­های کشورهای توسعه­یافته در زمینه اکتشافات فضایی نادیده گرفته نشود. عینیت یافتن این مفهوم منوط به ایجاد یک نظام بین­المللی برای اداره آن است و تا زمان ایجاد این نظام بین­المللی، این عنصر از طریق همکاری­های بین­المللی، در سایه­ی استفاده صلح­آمیز از فضای ماورای جو به­عنوان عنصر دیگر این اصل، محقق خواهد شد.

چکیده [English]

Most of lawyers have recognized five elements for common heritage of mankind in outer space. Outer space, moon and other celestial bodies couldn't be subject to possession. Also resulting interests of them should be equitably distributed among countries, so that regard developing countries activities beside interests of developing ones. The Interest  of mankind as one of another elements indicate us that economic exploitation of space should be compatible with mankind interest, shouldn't impair area environment  and results from space researches should be accessible for all to use, too. The materialization of this concept in outer space is subject to establishment of an international system for its management and until happening this, mentioned element has been come to pass with international cooperation in various dimensions. Fifth element - Peaceful use of outer space – that its interpretation in meaning of non-military use (opposite non-aggressive use) is more correspondents with thesis of common heritage of mankind, prepares the way for materialization of other elements.
