Given that the choice of each of these rules will result in a different level of protection for foreign investment, the main question of the present study is to determine which of the above rules is preferable to the other as special law and what are the implications of applying each one in such dispute and breach of which one can be invoked as the international responsibility of the host state to the investment. This paper analyzes the above question in an exploratory way to remove the legal gap regarding the conflict between international humanitarian law and international investment law in investment disputes arising from armed conflicts.}, keywords = {Conflict of Laws,foreign investment,Geneva Convention,Armed Conflicts,International Responsibility,bilateral investment treaties}, title_fa = {تعامل میان حقوق بین‌الملل سرمایه‌گذاری و حقوق بین‌الملل بشردوستانه در دعاوی سرمایه‌گذاری ناشی از مخاصمات مسلحانه}, abstract_fa = {در وضعیتی که سرمایه‌گذار خارجی بر اثر مخاصمات مسلحانه دچار آسیب شده است، قواعد حقوق بین‌الملل سرمایه‌گذاری در خصوص حفاظت از سرمایه‌گذاران خارجی و قواعد حقوق بین‌الملل بشردوستانه در خصوص حفاظت از غیرنظامیان که شامل سرمایه‌گذاران خارجی نیز خواهد شد، هر دو معتبر هستند و از آنجا که رویه خاصی در این زمینه موجود نیست، دیوان‌های داوری می‌توانند به اختیار خود در هر پرونده، یکی از آن‌ها را به‌عنوان قانون خاص اولویت داده و بر دعوا اعمال کنند. با توجه به اینکه انتخاب هرکدام از این قواعد منجر به ارائه سطح حمایتی متفاوتی به سرمایه‌گذاری خارجی خواهد شد، سؤال اصلی تحقیق حاضر آن است که انتخاب کدام‌یک از قواعد فوق به‌عنوان قانون خاص بر دیگری ارجحیت دارد و اعمال هریک موجب چه تبعاتی در این‌گونه دعاوی خواهد شد و بر اساس نقض کدام‌یک می‌توان به مسئولیت بین‌المللی دولت میزبان سرمایه‌گذاری استناد کرد. این مقاله با روش اکتشافی به بررسی سؤال فوق پرداخته تا خلأ حقوقی در خصوص تعارض میان حقوق بین‌الملل بشردوستانه و حقوق بین‌الملل سرمایه‌گذاری را در دعاوی سرمایه‌گذاری ناشی از مخاصمات مسلحانه رفع کند.}, keywords_fa = {تعارض قوانین,سرمایه‌گذاری خارجی,کنوانسیون ژنو,مخاصمات مسلحانه,مسئولیت بین‌المللی,معاهدات دوجانبه سرمایه‌گذاری}, url = {https://jls.shirazu.ac.ir/article_5696.html}, eprint = {https://jls.shirazu.ac.ir/article_5696_5f90a378fd071d739288db643ab3a748.pdf} }
