Sovereignty like Damocles sword can pave the way for maintaining the “status quo” or domination of premier economical powers in the international equations. While examnng the not-so-positive role of sovereignty on the procedure of setting relations between developing and developed states, this artciel attempts to emphasize the fact that balancing of existing economical unfair relations between north and south will not be possible, save by making inroads into the traditional concept of economical governance, the concept formed by developing states in 1960s and 1970s. Based on this, the present research  tackles the question of what is position of the economic sanctions in opposition the traditional concepts of sovereignty and independence of states with the concepts and facts of the current international legal order?}, keywords = {Economic Independence,sovereignty,Economic Sanctions,Globalization,Economic New Order}, title_fa = {چالش استقلال اقتصادی و حاکمیت دولت‌ها: نگاهی دوباره به مسئله مشروعیت تحریم‌های اقتصادی در واقعیت نظم حقوقی بین‌المللی}, abstract_fa = {      امروزه یکی از مسائل مبتلابه در عرصه جامعه جهانی، یافتن مبنایی برای تنظیم روابط اقتصادی دولت‌ها است. در حالی که هنوز دول در حال توسعه بر مقوله حاکمیت اقتصادی خود برای رویارویی و حفظ مواضع خود با دول توسعه‌یافته پای می‌فشارند، تحلیل واقعیت‌های حقوقی بین‌المللی نشان می‌دهد که صرف تکیه بر مقوله «استقلال اقتصادی» و «حاکمیت دائم بر منابع طبیعی» نمی‌تواند چاره‌ای عملی برای رسیدن به آرمان‌های دولت‌های در حال توسعه باشد. حاکمیت، همچون شمشیر داموکلس می‌تواند زمینه را برای حفظ «وضعیت موجود» یا سیطره قدرت‌های برتر اقتصادی در معادله بین‌المللی آماده کند. صرف تکیه بر حقوق بین‌الملل به عنوان شاخه‌ای مبتنی بر حاکمیت دولت‌ها برای تغییر شرایط موجود عملاً گمراه‌کننده خواهد بود. این مقاله با تحلیلی واقع‌گرایانه از نقش نه چندان مثبت حاکمیت در روند تنظیم روابط دول توسعه‌یافته و در حال توسعه درصدد است تا بر این واقعیت تأکید کند که تعدیل روابط ناعادلانه اقتصادی موجود جز با ایجاد شکاف در مفهوم سنتی حاکمیت اقتصادی در مفهومی که توسط دول در حال توسعه در سال‌های دهه شصت و هفتاد قرن بیستم شکل گرفته است، میسر نخواهد شد. تحریم‌های اقتصادی به عنوان واقعیتی از روابط بین‌المللی اقتصادی، در تقابل حاکمیت مطلق اقتصادی دولت‌ها با حقوق بین‌الملل نوین و در حال گذار قابل ارزیابی در این مسیر است. این مقاله سعی بر آن دارد به این سوال پاسخ دهد که تحریم‌های اقتصادی در تقابل مفاهیم سنتی حاکمیت و استقلال دولت‌ها با مفاهیم و واقعیات نظم حقوقی بین‌المللی کنونی از چه جایگاه و مرتبه‌ای برخوردار است؟  }, keywords_fa = {استقلال اقتصادی,تحریم‌های اقتصادی,حاکمیت,جهانی‌شدن,نظم نوین اقتصادی}, url = {https://jls.shirazu.ac.ir/article_5325.html}, eprint = {https://jls.shirazu.ac.ir/article_5325_ec7f98816be6171ea37921b7118178c7.pdf} }
